Issues concerning interest rates in Poland.

Many mortgages and loans in Poland were linked to the Swiss Franc in the past,

due to the low rates of interest of "Swiss Franc Mortagegs".

However due to foreign exchange fluctuations that brought a reduction in the value

of the Zloty, these loans have become extremely expensive in PLN values.

Polish courts have in recent times been seriously eroding this linkage

to the Swiss Franc.

Now there is a trickle of erosions concerning linkage to WIBOR

( Warsaw interbanking rate ). Recently a court in Wroclaw completely annulled

a loanagreement which was linked to WIBOR plus another element due to lack

of clarity in the drafting.

It is worth noting that in Poland the is no principle of binding precedent,

therefore, in order to draw conclusions you have to draw conclusions only

when there is a notable accumulation of decisions following a certain
