Traffic Law Issue

According to the Polish traffic law the head of a local authority ( starosta )

can administratively withhold a driving license, in two cases.

  1. Overspeeding of over 50 km per hour of the speed limit. In that case he can withhold a license for 3 months.

  2. carrying more people in the car than the designated number of seats. In that case he can withhold a license for 6 months.

The Supreme court of Poland abolished the above articles.

The reasoning was that it contradicts the Polish constitution which guarantees due process.

In our case denying the drivers the right to challenge the decision, by presenting their version of the facts, is contradictory to the principle of due process
